Preamble

This Refund and Cancellation Policy ("Policy") governs the purchase of digital goods and services from Vehicle Data LLC ("Company," "We," "Us," or "Our"), doing business as VINReport.com. By purchasing a Vehicle History Report, subscribing to a data plan, or using our API services, you ("User," "You," or "Your") agree to be bound by this Policy.

PLEASE READ THIS POLICY CAREFULLY BEFORE MAKING A PURCHASE. OUR SERVICES ARE DIGITAL AND IRREVOCABLE UPON DELIVERY. THIS POLICY OUTLINES THE LIMITED CIRCUMSTANCES UNDER WHICH REFUNDS MAY BE GRANTED.

Article 1: Nature of Digital Goods

1.1. Immediate Consumption

You acknowledge that the Vehicle History Reports ("Reports") and VIN decoding services provided by VINReport.com constitute "Digital Goods." Unlike physical products, Digital Goods are consumed immediately upon generation and delivery to your screen or dashboard.

1.2. Performance of Service

The Company's service is deemed fully performed when the data query is sent to our third-party sources (including NMVTIS, state DMVs, and auction databases) and the resulting information (or lack thereof) is displayed to You. Consequently, there is no physical product to return, and "return" of the Digital Good is technically impossible.

Article 2: General Refund Policy

2.1. All Sales Final

Except as expressly set forth in Article 3 of this Policy, ALL SALES ARE FINAL AND NON-REFUNDABLE. By clicking "Checkout," "Buy Now," or "Subscribe," You waive any right to a refund based on personal preference, change of mind, or dissatisfaction with the vehicle's history.

2.2. Service Fees

Any transaction fees, processing fees, or taxes applied to Your purchase are non-refundable, unless the underlying transaction itself is fully refunded due to a technical error on Our part.

Article 3: Refundable Circumstances

3.1. Technical Failure

A refund may be issued if a technical error on the Site prevented the Report from being generated or delivered to You after payment was successfully captured.

Example: You paid for a report, the site crashed, and You never received the link or access to the data.

3.2. Duplicate Charges

If You were charged multiple times for the exact same VIN report due to a payment processing error or accidental double-click, We will refund the duplicate transaction(s).

3.3. Incorrect Report Generation

If the Report generated does not match the VIN You entered (e.g., You entered a VIN for a 2018 Ford, but the system returned data for a 2015 Honda), We will issue a full refund or provide the correct Report at no additional cost.

Article 4: Non-Refundable Circumstances

For the avoidance of doubt, refunds will NOT be issued under the following circumstances:

4.1. Data Discrepancies (Third-Party Data)

VINReport.com aggregates data from third-party sources. We do not create the data. We are not responsible for errors, omissions, or outdated records in the source databases.

  • No Refund: If a Report fails to show an accident that You know occurred.
  • No Refund: If the odometer reading is different from what is currently on the dashboard.
  • No Refund: If the title status is not yet updated by the state DMV.

4.2. "Empty" or Limited Data Reports

You are paying for the search service, not a guaranteed volume of data. Some vehicles (especially older models or those from non-participating states) may have little to no recorded history.

No Refund: If the Report says "No Records Found" or contains only basic decoding information. This indicates that our sources have no adverse history to report, which is a valid result.

4.3. User Error

You are responsible for the accuracy of the information You input.

  • No Refund: If You mistype the VIN.
  • No Refund: If You purchase a report for the wrong vehicle.

4.4. Buyer's Remorse

  • No Refund: If You decide not to buy the car after seeing the Report.
  • No Refund: If You find the same information for free elsewhere.
  • No Refund: If You simply "changed your mind."

Article 5: Subscription and Cancellation Policy

This Article applies to users who subscribe to recurring billing plans (e.g., Dealer Plans, High-Volume Accounts).

5.1. Automatic Renewal

Subscriptions automatically renew at the end of each billing cycle (monthly or annually) unless canceled by You. You authorize Vehicle Data LLC to charge Your payment method for the renewal term.

5.2. Cancellation Procedure

You may cancel Your subscription at any time through Your account dashboard or by contacting support@vinreport.com.

  • Timing: To avoid being charged for the next cycle, You must cancel at least 24 hours before Your renewal date.
  • Effect of Cancellation: Your access to subscription features will continue until the end of the current paid billing period.

5.3. No Prorated Refunds

We do not offer prorated refunds for partial months or unused report credits. If You cancel mid-cycle, You will not receive a refund for the remaining days in that cycle.

Article 6: Dispute Resolution and Chargebacks

6.1. Contact Support First

If You believe a charge is erroneous, You agree to contact support@vinreport.com to resolve the issue before initiating a dispute or chargeback with Your bank or credit card issuer.

6.2. Abuse of Chargebacks

Filing a chargeback for a valid transaction (often called "friendly fraud") is a violation of these Terms.

  • Account Ban: If You institute a chargeback without merit, We reserve the right to permanently suspend Your account and block Your IP address and payment method from future use of our Services.
  • Dispute Evidence: We will submit this Policy, Your IP address, timestamps, and access logs to the payment processor or bank as evidence that the Digital Good was delivered and the service was performed.

Article 7: Requesting a Refund

To request a refund, You must follow these procedures to ensure Your claim is processed efficiently.

7.1. Submission Channel

All refund requests must be submitted via email to support@vinreport.com.

7.2. Required Information

Your email must include:

  1. Subject Line: "Refund Request - [Your Transaction ID]"
  2. The VIN: The Vehicle Identification Number of the report in question.
  3. Reason: A clear explanation of why You are requesting a refund (e.g., "Duplicate Charge," "Technical Failure").
  4. Evidence: If claiming a technical error, please attach screenshots if available.

7.3. Processing Time

We aim to review and respond to all refund requests within five (5) business days. If approved, refunds will be processed to the original method of payment. Please allow 5-10 business days for Your bank to reflect the credit on Your statement.
